Terms & Conditions

1 Interpretation

1.1 Definitions
Contract: the contract between us formed when we accept your Order, subject to these terms and conditions.
Order: means your offer to sell us your device(s), and the subsequent process required to do so, subject to these terms and conditions.
Order Form / Online Valuation Form / Form: the form on our website, to be completed as accurately as possible by you, to enable us to provide an estimated price we will pay for the device(s).
Recycle / Recycled: salvage for parts and/or safely dispose of any device in question.
Sales Pack: a copy of the order form, packaging materials including a packaging guide, checklist of points.

1.2 Before sending us your device read the following Terms and Conditions. These are the terms and conditions on which we ("Cash4Tech, we, us, our") will buy your device(s) from you ("customer, you, your") through the website. By sending us your device(s) you agree to be bound by the terms and conditions set out here.

1.3 Corporate customers should read the terms and conditions but be aware that they may vary depending what is agreed between you and us.

1.4 Before sending us any device(s), please read these terms carefully. Ensure you take note of your devices IMEI number(s) in case there is a problem with your Order. The IMEI number is a unique device identification number that can be found by typing in *#06# to your dial screen (or in your device’s settings). It should also be printed on the back of your device or under the battery cover or one of the other covers (further information could be found on the device’s manufacturers’ website).

1.5 Please ensure all personal data is removed from your device before sending it to us. We cannot be held responsible for your personal data if you have not removed it from your device(s) or if your device is lost in transit when being sent to or returned by us. In particular, if you send us a non-functioning device we may not be able securely erase it. If this is the case and you choose to leave it with us we will destroy the board that contains the data.

2 Accessories / SIM Cards / Data Cards

2.1 Please remove all SIM and data cards before sending us your device. All SIM or data cards received by us will be securely destroyed and will not be returned in any case. We accept no liability if any device sent to us with a SIM or data card is lost and charges are then incurred. You will still be responsible for all such charges. We accept boxes, chargers and accessories but they do not increase the estimated price and we may not be able to return them.

3 About Us

4 Your Order

4.1 For each device sent to us, an Online Valuation Form must be completed, after which we will provide you with an estimated price. The Form must be complete and accurate. If the Order Form information is not complete or accurate, you may not receive the full value of the estimated price.

4.2 By submitting an Order, you will create an account on our site, this will allow you to track your Order and its progress. The details entered will be used to process the sale / purchase, payment, delivery and future offers (if selected).

4.3 To submit an Order and sell us a device, you must be:

a a UK resident accessing our site from the UK (currently we only offer this service in the UK);

b able to enter into a binding contract;

c at least 18 years old (or have obtained your parent or guardian’s consent to the relevant sale for the sum indicated on our site); and

d the owner of the device or have obtained consent from the owner to sell it.

4.4 Following acceptance of your Order Form we will send you a Sales Pack or details (through email) for you to send us the device(s).

4.5 When sending your device, please ensure all the information on the Sales Pack is still correct if there is an issue please contact is before sending.

5 Your Device

5.1 Any device you send to us must match the details provided on your Order Form and by sending it to us you confirm that:

a it is owned by you (or that you have full permission to be able to sell the device);

b the device meets the criteria given;

c it includes its battery within the casing and does not have any missing components and / or parts;

d it is not crushed, bent or liquid-damaged;

e it is not security locked (PIN or password, Activation locked iCloud or Android) or any other form of locking feature;

f the firmware has not been altered or tampered with ("Jail Broken" or "Rooted");

g it is original and meets the manufacturer’s original specifications (and is not personalised with any custom engraving);

h it is not blocked by any network (This is not the same as locked to a network); and

i the device is not blacklisted or reported lost or stolen.

5.2 If you send us a device which does not comply or meet with the above requirements, we may contact you to notify you that we will not be purchasing your device. If we refuse to buy it you may ask us to return it (at your cost) or Recycle it. If we are unable to contact you within 28 days of receiving the device, we will automatically Recycle it at our expense.

5.3 If your device is security locked, we will contact you to ask for your help in unlocking it, if you do not or cannot help us unlock the device, we can return it (at your cost) or we can Recycle it at our expense. If we are unable to contact you within 28 days of receiving the device, we will automatically Recycle it.

5.3 You will not receive any payment for devices which are returned or Recycled.

6 Receive Your Device

6.1 Once we have received your device(s), we will check the device over. It will then have a history and diagnostics check performed to ensure everything is satisfactory and that it meets the criteria we have set and you have selected when making the Order.

6.2 When we have confirmed the status of your Order we will then send you confirmation of your success (and our acceptance) followed by the payment via the method that you selected or send out a revised quote explaining the new price. Once we have sent a revised quote you have 28 days to accept the quote or ask us to return your device. If we are unable to contact you within 28 days of receiving the device, we will automatically Recycle it at our expense.

6.3 Once the device has entered our facility it will not leave until:

a the customer (you) have been paid; or

b we have allowed the 28 days for the customer (you) to update us on what you would like us to do; and

c the device has been securely erased (or the board containing confidential information has been destroyed).

7 Prices

7.1 Prices displayed on our website include any applicable VAT and other tax, and are subject to change at any time without notice. Device prices are variable, if you check the value of your device but do not place an Order, the value may be different at a later time.

7.2 Any offers on device prices are subject to any terms which we impose and may be varied or withdrawn at any time without notice. All prices are paid in pounds sterling.

7.3 The estimated price of any device is guaranteed for 14 days, subject to the device complying with these terms and conditions. We may remind you if we have not received your device within 14 days of your Order Form being submitted.

7.4 To be accepted, your device must be received within 14 days following your submission of an Order Form and comply fully with these terms and conditions.

7.5 If your device is received more than 14 days following your Order or does not comply with these terms and conditions then reduced prices may apply or we may refuse to buy your device.

8 Reduced Price

8.1 When we examine or test your device, we will not pay as much as the original, indicative value if we find that your device does not comply with all our terms.

8.2 If a reduced price applies, we will contact you to make a reduced offer with a detailed explanation and reason as to why. If you reject this offer we will return it at your cost or if we are unable to contact you within 28 days of receiving the device, we will automatically Recycle it.

8.3 Our decision is final on all device prices.

9 History Check

9.1 We check all mobile devices we receive against a national database.

9.2 If your device has a red flag (meaning it has been registered as lost, stolen, barred or blocked on the database), we will update you accordingly and quarantine it for 28 days while its status is reviewed.

9.3 If we notify you that your device has a red flag you will need to contact your provider or law enforcement accordingly to get this removed.

9.4 If the red flag is removed before the end of the quarantine period, we may process and purchase your device in accordance with these terms and conditions. If the red flag is not removed before the end of the quarantine period, we are required by law to dispose of it or provide it to the police and you will not receive any payment. By law we cannot under any circumstances return the device during this 28 day period unless the red flag has been removed.

9.5 If we become aware of any issues with your Order you may be required to co-operate with the authorities. We reserve the right to withhold or cancel payment depending on the outcome.

9.6 If we become aware of a red flag or other ownership issue with the device and we have already paid you for the device, you agree to return that payment on our notification, and accept that we may take steps to recover that amount and any associated costs of recovery.

10 Payments and Ownership

10.1 Ownership of the device will pass to us when we dispatch payment to you or (if applicable) when we Recycle the device.

10.2 Payments will be sent by the chosen method in your Order Form. If you wish to amend your payment method, please contact us before payment is sent.

10.3 Payment will only be sent following receipt, testing and acceptance of your device (or under the "Reduced Price" process set out above).

10.4 We aim to issue payment within 2 working days of acceptance of your device. You should allow 2-3 working days for cheques to be processed. However, this timescale is for guidance only and we cannot guarantee payment within that time.

10.5 Payments are also subject to validation and security checks which we or third parties may stipulate from time to time.

10.6 Payments processed by post will be sent first class using the Royal Mail postal service.

10.7 All valuations include VAT (or other applicable tax) at the applicable rate.

10.8 Payment processing depends on third parties (ie -postal service and banks) whom we do not control, and on the details you provide when completing the Order Form. We do not accept liability for any delay or failure in your receipt of payment as a result of those third parties’ action or inaction or your provision of inaccurate details.

11 Postage and Returns

11.1 You must ensure that you are happy to send the device to us and that you are within your rights to do so.

11.2 You send your device to us at your own risk. We cannot be responsible for devices we do not receive, or for the condition in which we receive devices. We recommend that you package your device carefully to minimise the risk of damage. All devices must be sent in accordance with Royal Mail 1st Class guidance. 11.3 Do not include additional devices in the package, if only one Order has been created. Additional items may not be returned. If we can return additional items, it will be at your cost. If the device is not returned it will be Recycled regardless. You will not receive any payment for devices which are Recycled.

11.4 We recommend devices be sent to us by Royal Mail 1st Class by using the freepost service included in our Sales Pack. If you choose to use another service which we have not agreed, your postage costs will not be reimbursed.

11.5 If another service is used you will be responsible for obtaining and providing tracking details. If you use the freepost label provided, your phone will only be insured in transit by Royal Mail and subject to their limits. If there is an issue with part of this service, contact Royal Mail and follow their complaints procedure. This can be found by going to www.royalmail.com.

11.6 Once we receive your item, you will be informed by way of email.

12 The Contract

12.1 By completing and submitting the Order Form it is an offer by you to sell the device to us. The contract between us and you is formed, subject to these terms and conditions, when we confirm receipt and acceptance of your Order Form. The contract between you and us is conditional upon us receiving the device in accordance with these terms and conditions. The estimated price may be varied as set out in these terms and conditions.

12.2 Our contract with you will terminate or expire when we buy, Recycle or return your phone in accordance with these terms and conditions.

12.3 You may cancel your contract with us without any charge at any point up until you have sent the device to us. After this you will not be able cancel your contract with us (but it may be terminated or expire as provided for in these terms and conditions).

13 Events Outside of Our Control

13.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under our contact with you that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.

14 General

14.1 These terms and conditions are governed by English law. Claims in relation to our contract with you are subject to the jurisdiction of the courts of England and Wales. We reserve the right to change these terms and conditions from time to time in our discretion.

14.2 To contact us in relation to our contract with you, please use the methods of communication set out in these terms and conditions. If we need to contact you, we may do so using any of the contact details you provided to us, including in your Order Form.

14.3 If a court finds part of our contract with you unenforceable, the rest will continue in force. Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

14.4 This contract is between you and us. It is not transferable without our prior written consent this includes any rights or obligations within. We may transfer our rights and obligations under this contract at any time (we will let you know and ensure that this does not affect your rights under your contract with us). No person other than you and us shall have any rights to enforce any of the terms of this contract.
